Our service agreement outlines what you can expect from us and what we ask of our clients.
Effective Date: This agreement is effective as of the date of deposit.
Section 1
Parties & Effective Date
This agreement is effective as of the date of deposit — between Houdini Portraits LLC and the Client.
Section 2
Services
The Photographer/Videographer agrees to provide photography/video services as outlined in the attached proposal or invoice.
Section 3
Payment & Deposits
- Deposit: A non-refundable deposit of 30% of the total price is required to secure the appointment. This deposit covers preparation costs and is applied to the total fee.
- Balance: The remaining balance is due on the day of the shoot/event.
- Kill Fee: Cancellations within 72 hours of the appointment incur a kill fee of 50% of the total price in addition to forfeiting the deposit.
Section 4
Watermark Policy
Watermarks will no longer be added to photos after full payment. Enjoy the beauty of a clean, quality image.
Section 5
Artistic Style & Editing
The Client acknowledges the Photographer/Videographer's distinct artistic and editing style. Custom editing requests outside this style are not permitted to maintain brand consistency unless otherwise stated in a mutual written agreement.
Section 6
Turnaround & Delivery
- Standard Delivery:
- 7 business days for Photoshoots
- 14 business days for Events
- 21 business days for Quinceañeras & Weddings
- Expedited Delivery: Available upon formal request (email/phone) for an additional fee.
- Delivery Method: Final files delivered via Dropbox link. Client must download files promptly.
Section 7
Scheduling & Rescheduling
- Appointments: Clients must arrive on time. Late arrivals forfeit their deposit without refund.
- Rescheduling:
- Permitted if requested ≥120 hours before the appointment (no new deposit required).
- Requests <120 hours require a new deposit (subject to availability).
- All rescheduling is subject to availability.
Section 8
Studio Policies
- Security: All studio interactions are recorded for safety and ethical compliance.
- Conduct: The Photographer reserves the right to terminate services without refund for rude, irate, or policy-violating behavior.
- Attire: The following will NOT be allowed and will result in the conclusion of your appointment without refund: Nudity, Lingerie, Sexual Themes, Profanity (design or clothing).
Section 9
Client Responsibilities
- Provide shot lists, location permits, or necessary approvals at least 24 hours prior to the shoot.
- Ensure all subjects under 18 are accompanied by a parent/guardian during the session.
Section 10
Copyright & Usage Rights
- Copyright: The Photographer retains full copyright ownership of all images/videos.
- License: Client receives a non-exclusive, personal-use license. Commercial use requires written consent.
- Model Release: Client grants permission for the Photographer to use images/videos in portfolios, marketing, or publications unless otherwise stated in a mutually written agreement.
Section 11
Indemnification
The Client agrees to cover all costs, damages, or legal fees arising from third-party claims related to the shoot (e.g., unpermitted locations, unapproved subjects).
Section 12
Termination & Liability
- Termination: The Photographer may cancel services for policy violations, retaining the deposit.
- Liability: The Photographer is not liable for unforeseen circumstances (e.g., equipment failure, weather).
Section 13
Communication
Phone Business Hours: 7:00 AM – 5:00 PM. Emails/calls outside these hours may be addressed during the next business day. Text messages are not a prioritized form of communication. Be sure to call or email for a prompt response.
